1. Acceptance of Terms

By accessing or using the Articulait platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Articulait, Inc. ("Company", "we", "our", or "us").

2. Description of Service

Articulait provides AI-powered real estate media tools including virtual staging, video tour generation, 3D walkthroughs, and photo enhancement services. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to: (a) upload or process content you do not have the right to use; (b) violate any applicable law or regulation; (c) infringe any intellectual property or privacy rights of others; (d) transmit any harmful, offensive, or disruptive content; (e) attempt to gain unauthorized access to our systems or networks; or (f) use the Service for any commercial purpose not expressly permitted by us.

5. AI-Generated Content

The Service uses artificial intelligence to generate images, videos, and other media. You acknowledge that AI-generated content may contain inaccuracies or artifacts. You are solely responsible for reviewing and verifying all AI-generated content before using it for any commercial purpose. Articulait does not warrant that AI-generated content is accurate, complete, or fit for any particular purpose.

6. Intellectual Property

You retain ownership of any original content you upload to the Service ("User Content"). By uploading User Content, you grant Articulait a non-exclusive, worldwide, royalty-free license to use, process, and display that content solely to provide the Service. All AI-generated outputs derived from your User Content are owned by you, subject to these Terms. Articulait retains all rights in the Service, including its underlying technology, branding, and platform.

7. Credits and Billing

Access to certain features requires the purchase of credits or a subscription plan. All fees are non-refundable except as required by applicable law. We may change our pricing at any time by providing notice through the Service or via email. Continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Limitation of Liability

To the maximum extent permitted by law, Articulait shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
